What are chance that your website will be shut down for copyright infringement of pictures if they are not famous? If your site is found to be using copyrighted pictures without permission, do they totally destroy your site without saving the data and hence make it un-retrievable? or do they give you time to take it down?

Why would you use photos you don't have premission to use? Copyright infringement of pictures is really not cool, and illegal as well.

As Doug said, it depends on the host, but in most cases they'll take the site down. What "take the site down" varies - some would delete it, while others simply "switch it off".

Of course, you wouldn't use copyrighted images without permission, and you'd have regularly scheduled backups of your website and it's data wouldn't you?

That depends on the TOS (terms of service) of the webhost where you host your site. Easy way to avoid the issue: don't use copyrighted pictures.
